Blogger arrested, accused of posting 9 unreleased Guns N' Roses songs
Kevin Cogill, 27, of Culver City, who admitted to allowing public access to the songs on the Antiquiet blog, was arrested today on suspicion of violating federal copyright laws.

A man accused of posting nine previously unreleased songs by the rock band Guns N' Roses on a website where they could be accessed by the public was arrested at his home early today on suspicion of violating federal copyright laws, authorities said.
Kevin Cogill, 27, is accused of posting the songs, which were being prepared for commercial release, on the Internet blog Antiquiet in June, according to an arrest affidavit. The site received so much traffic after the songs were posted that it crashed, the affidavit states.
Cogill admitted to posting the songs when he was questioned by an FBI agent, according to the affidavit. He was arrested at his home in Culver City this morning and is expected to appear in U.S. District Court in Los Angeles later today, said Assistant U.S. Atty. Craig Missakian.

It's been nearly 10 years since the name of Guns N' Roses latest album surfaced. But fans are still waiting for the record. Some recent events point to a possible release, which begs the question: Is this the year of "Chinese Democracy"? On Sept. 17, 1991, music fans from across the world streamed into record stores to buy new music from Guns N' Roses.
It was the first time in the modern era that a major recording artist released two albums on the same day, an act that was, ultimately, orchestrated by the band's lead singer, W. Axl Rose.
Although the critical reception was mixed, 'Use Your Illusion I' and 'Use Your Illusion II' blasted to the top of the Billboard charts with first-week sales of 685,000 and 770,000 copies, respectively. It would take until late 2007 for two albums released in the same week to both sell more than 600,000 copies each.
Yet what these fans — and, indeed, the band members themselves — did not know was that it would be the last collection of new material released by a band that only four years earlier had slithered out of the gutters of Los Angeles to assume the rock god crown.
In the 17 years since, every member of the band that recorded the 'Illusion' records has left the band — except for Rose. Some, like drummer Matt Sorum, were fired. Others, like lead guitarist Slash and bassist Duff McKagan, got fed up with Rose's shenanigans and just quit. But Rose still has the band's name, thanks to a series of legal maneuvers, and over the years he assembled a mish-mash of musicians to create 'Chinese Democracy' — one of the most famous albums never released.
So, will this be the year that Rose finally unleashes 'Chinese Democracy' upon the masses? It's an almost ridiculous question to ask, as those who have been waiting for the 'new' version of Guns N' Roses to appear on store shelves have grown weary of the oft-repeated cycle of anticipation and disappointment.
Despite the odds, it appears that Rose is finally ready to bring the waiting to an end.
'Chinese Democracy' emerged as the title of Rose's new album almost 10 years ago, and a 2000 Rolling Stone magazine article named five song titles. Since that time, reports and rumors have linked to the project at least 10 different musicians (ranging from the eccentric guitar virtuoso Buckethead to the legendary Brian May of Queen) and five producers, including Rose himself.
Unlike the previous years — 2000, 2002, 2004 and 2006 — in which Rose either has hinted he would release the record or toured with the band he called Guns N' Roses, this year has brought a series of events that may finally lead to its release.
In years past, Rose has rebuffed any perceived attempts to cajole from him a finished record. In fact, when a talent executive for Geffen Records sent Rose a stash of CDs in 1997 in an effort to get him to select a producer for 'Chinese Democracy,' Rose placed the albums in his driveway and drove over them with a car, according to a 2005 story in The New York Times.
But when Dr. Pepper announced in March that it would give a can of its 23-flavored soft drink to everyone in the nation (save for Slash, who left the band in 1996, and Buckethead, who parted ways with Rose in 2004) should 'Chinese Democracy' be released before Dec. 31, Rose stunned the music world with his response, which he posted on the band's official Web site.
'We are surprised and very happy to have the support of Dr. Pepper with our album 'Chinese Democracy,' ' Rose said in the statement. 'As for us, this came totally out of the blue. If there is any involvement with this promotion by our record company or others, we are unaware of such at this time.
'And as some of Buckethead's performances are on our album, I'll share my Dr. Pepper with him.'
This soon was followed by confirmation that Rose had turned over some form of finished project to his record label, Geffen/Interscope, and hired a new management team.
Then, on July 14, it was announced that a track from 'Chinese Democracy' would be included in the upcoming video game 'Rock Band 2.' Several rumors surfaced in the days that followed, ranging from speculation that 'Chinese Democracy' will hit stores in early September to coincide with the annual MTV Video Music Awards — where Axl turned in an embarrassing 'return' performance in 2002 — to the idea that 'Chinese Democracy' will be not one, but four albums released simultaneously.

The only official release that Rose has authorized is a song called 'Oh My God,' which was included on the soundtrack of the 1999 movie 'End of Days.'
Fans, though, have found ways to hear far more of the Rose's new GnR studio material.
Since 2004, songs have leaked to the Internet at least three times. Immediately following each leak, the sites that hosted them were hit with cease-and-desist letters from the band's legal team. But the damage already was done, as users on torrent and peer-to-peer networks continued to share them and operators of some Web sites blatantly refused to remove the illegal tunes.
With the first leak came the songs 'There Was a Time,' 'I.R.S.,' 'The Blues' and a snippet of a song called 'Better.' The audio quality clearly indicated that these were very rough mixes of these songs, but Axl's voice was unmistakable.
In 2006, Rose told Rolling Stone magazine that fans 'will hear new music this year.' While no album was released, a second round of leaks later that year included the same three complete songs, a longer snippet of 'Better,' and the previously unheard studio track 'Chinese Democracy.' The sound quality was improved, but the songs clearly were not meant for widespread sale.
But curiosities were indeed piqued.
Then came June, when nine songs of what appeared to be CD quality sound were leaked. The songs again included the same four from the first two leaks and a full version of 'Better,' plus previously unheard studio takes of 'Madagascar' and 'Rhiad and the Bedouins' (both of which the band played on its 2004 and 2006 tours) along with songs rumored to be titled 'If the World' and 'This I Love (Misunderstood).'
The songs first showed up on the Web site Antiquiet.com, operated by a blogger named Kevin Skwerl. News reports later said Skwerl, who removed the songs almost as soon as he posted them, was a former employee of Geffen/Interscope records and received a visit from the FBI on June 23, just days after he posted them. Yet those same reports, some of which included interviews with Skwerl, made no mention of criminal charges.
GnR spokeswoman Anna Loynes said the band had no comment on the leaks. In fact, she wouldn't even confirm whether they were the band's songs.

Some, including British reporter Mick Wall, who released in February 2008 a book on Rose's life, have claimed the countless delays in the release of 'Chinese Democracy' were linked to Rose's need for obsessive control over the album's public introduction as well as his inability to be satisfied with the finished product.
Rose's past certainly lends credence to both theories, as Wall alleges in 'W.A.R.: The Unauthorized Biography of William Axl Rose,' how the singer systematically positioned himself to seize total control of the Guns N' Roses brand while delaying for months the release of the 'Illusion' records.
Even Slash, in his 2007 biography, said Rose's tyrannical ways is one of the primary reasons he left the band.
'I'd like to state, very simply once more why I chose not to continue on with Guns N' Roses ...,' Slash wrote. 'Here it goes: 1) the constant disrespect for all involved by going on late for no good reason night after night, 2) the legal manipulation that Axl forced on us, from demanding ownership of the name to downgrading us, contractually, to hired hands and 3) losing Izzy [Stradlin] and Steven [Adler, the band's original rhythm guitarist and drummer] ... without them, the band no longer had its original chemistry.'
But another theory floating among the Internet fan sites is that these moves could be the greatest viral marketing campaign of all time.
Warner Bros. used viral marketing and other unorthodox advertising methods to raise interest in 'The Dark Knight,' director Christopher Nolan's follow-up to the 2005 film 'Batman Begins.' Since it's July 18 release, 'Knight' has shattered box office records and, as of Monday's weekend figures, had brought in more than $441.5 million in the United States alone, behind only 'Titanic' and the original 'Star Wars' in all-time box office.
So, could Rose be using rumor and speculation to cheaply hype a record that The New York Times said in 2005 had cost more than $13 million to record. That was three years ago — how much more money has been invested in 'Chinese Democracy?'
Only one man has the answers to all these questions.
And so far, he's satisfied with keeping us guessing.
After more than a decade of waiting for a new Guns N' Roses album, it seems a little ridiculous to continue speculating on when it will actually come out. But there is some renewed vigor to the Chinese Democracy rumors as Billboard reports that negotiations are underway for the album to come out as an exclusive at either Wal-Mart or Best Buy. Negotiations are also ongoing for the possibility of conventional record company distribution, another source says. However, Guns N' Roses is now managed by Irving Azoff's Front Line Management, and Azoff is a well-known proponent of issuing albums exclusively through retailers. He released The Eagles' Long Road Out of Eden through Wal-Mart, and it was a huge success.
Last month it was revealed that the first official taste of Chinese Democracy would appear in the sequel to the video game Rock Band. The new GNR tune included on Rock Band 2 will be called "Shackler's Revenge." The game will be out for the Xbox 360 in September.
Also, back in April, guitarist Robin Finck left GNR to return to Nine Inch Nails and tour with them this summer. "Robin's plans caught everyone in Guns, as well as our fans, a bit off-guard," read a post on the GNR Web site. "Neither we nor management know any more in this regard and we prefer not to speculate or offer opinions at this time. Robin's Robin. We're in negotiations for the release of Chinese Democracy and things are going well. When we begin to put tour plans together, we'll see where things are. Until then, Robin's touring with NIN and we're working with management on our game plans."
After a mess of leaked GNR tracks popped up a few months back, another new cut has apparently popped up online. "Shackler's Revenge" (which was supposed to have its premiere on the upcoming sequel to the video game "Rock Band") opens with a deep-voiced Axl gradually building towards his characteristic yowl, and features guitar noodling that is very likely the work of the man called Buckethead. The song's low crunch sticks with the album's long-stated industrial leanings, and again, layers upon layers of Axls create a particular sort of demented choir. We're getting thirsty for some Dr. Pepper.
So, I was watching the Lolapallooza (sp?) webcast recently and I managed to catch the John Butler Trio. I am a self admitted throwback, I don't listen to any radio except the classic rock station but I am becoming obsessed with this band, they kick some major ass and I hope to catch them the next time they play the NY area:
When the shooting stopped, two dogs lay dead. A mayor sat in his boxers, hands bound behind his back. His handcuffed mother-in-law was sprawled on the kitchen floor, lying beside the body of one of the family pets that police had killed before her eyes.
After the raid, Prince George's County police officials who burst into the home of Berwyn Heights' mayor last week seized the same unopened package of marijuana that an undercover officer had delivered an hour earlier.
What police left behind was a house stained with blood and a trail of questions about their conduct. No other evidence of illegal activity was found, and no one was arrested at Mayor Cheye Calvo's home in this small bedroom community near College Park.
This week Prince George's police arrested two men for orchestrating a plot to deliver marijuana to the addresses of unsuspecting recipients -- among them, Calvo's wife, Trinity Tomsic.
Yet neither county Police Chief Melvin C. High nor Sheriff Michael A. Jackson have apologized to him, his wife or her mother, Georgia Porter, for the raid that traumatized the family and killed their black Labrador retrievers, Payton and Chase.
Thursday, Calvo called on the U.S. Justice Department's civil rights division to investigate the raid and other similar actions by Prince George's law enforcement. He said officers burst into his house without knocking or announcing themselves, in violation of the warrant they had.
"Trinity was an innocent and random victim of identity theft. Apparently, so were four or five other county residents whose names and addresses were stolen and used as addresses on drug packages," Calvo said at a news conference outside his house, near a garden of tomatoes and strawberries.
"However, Trinity and our family have not been treated as victims of a crime. Instead, our home was invaded. Our two beloved Labrador retrievers are dead. My mother-in-law and I were tied up for nearly two hours," he said. "We were harmed by the very people who took an oath to protect us."
Berwyn Heights police Chief Patrick A. Murphy appeared with the mayor Thursday and said his agency was never informed of the investigation, despite an existing memorandum of understanding to work together on such operations.
He said not knowing about the raid could have led his officers to fire upon the sheriff's SWAT team because its members were wearing street clothes, masks and carrying weapons as they approached the mayor's house.
"What about the safety of my officers?" Murphy said. If consulted, he added, "We could have gotten the mayor to put the dogs away and consent to a search."
Police officials in Arizona first intercepted the package when a drug-sniffing dog alerted them to the presence of marijuana. It was addressed to Tomsic. An undercover officer in Prince George's delivered the package near 6 p.m. and was told by Calvo's mother-in-law to leave it on the porch, according to Calvo's attorney, Timothy Maloney.
Prince George's County police arrested two men involved in a scheme to transport marijuana. Once packages were dropped off by a deliveryman, a suspect would pick them up -- with the addressee oblivious to the plot. Police seized a half-dozen packages that contained about 417 pounds of marijuana, including the 32 pounds delivered to Tomsic, the Associated Press reported.
Last Tuesday, the mayor arrived home from his full-time job as an executive with SEED Foundation, which establishes urban public charter schools. He took the unopened package inside and placed it on a table near the door. He changed clothes and walked the dogs, waving to the men and women sitting in cars near his home. He did not know they were police.
He returned and went upstairs to get dressed for an event. As he changed clothes, SWAT team members darted across the fenced-in lot. Porter, 50, was cooking artichokes in the kitchen and screamed when she saw the approaching masked men with guns.
The door was kicked in and gunshots rang out, Calvo said. Police killed one dog, Payton -- named for football running back Walter Payton -- even though Porter was standing next to him.
Police have said the dogs "engaged" officers. Calvo confirmed that Payton probably moved toward the door but would have ultimately done nothing more than lick them.
"He was an aggressive licker," said Calvo.
Cheryl Compton, a neighbor, said her two sons, 5-year-old Cody and 7-year-old Ty, played with the mayor's dogs all the time, and that everyone but the Prince George's County police knew where Calvo lived.
"I would have let them stay in a yard by themselves with those dogs," Compton said. "It really upsets me to think that I don't feel safe in my home. If they were to shoot our dog, Amber, I would be outraged."
Chase was shot while running away from sheriff's deputies, Calvo said.
"He was hunted down and shot in the back while he fled," he said. "They didn't deserve to die. They don't deserve to be blamed for their deaths."
Calvo, 37, who has been mayor since 2004, was told to walk backward down the stairs with his hands in the air. He was wearing only boxers and socks. Police handcuffed him and placed him in the living room. His mother-in-law was also cuffed and made to lie on the kitchen floor next to Payton's body.
Police said they were allowed to enter the house without announcing their presence because Porter screamed and because they had a "no-knock" warrant. Calvo and his attorney, Maloney, say that is not true.
When Tomsic arrived home, she said, she thought the house had been robbed and that police had responded with an impressive show of force. But when she saw the blood and learned what had happened to her dogs, she was in shock.
"They were my kids," said Tomsic, 33, an employee with Maryland's Department of Human Resources. "All I could see was the blood and the tissue of the dogs."
Cleaning the blood, which police tracked throughout the house, was the top priority after the police left four hours after the raid, Calvo said.
"The blood was horrendous," Calvo said. "They had tracked it everywhere."
The couple bought the corner lot home nearly three years ago and asked Porter to move from Utah to live with them about 13 months ago. On the front fence, supporters have draped an American flag banner that reads, "Cheye & Trinity We Support You." Dozens of people have written personal messages to the family on the banner.
Robert Kovalchik, a neighbor and Calvo's high school history teacher at Parkdale High School, said he was shocked that county officials had not apologized.
"This smacks of something from Nazi Germany," Kovalchik said.
Calvo said he wants federal officials to examine policies that he said have led Prince George's police officials to serve warrants on wrong addresses and kill family pets before.
In once such case, Prince George's sheriff's deputies executed a warrant on the home of Frank and Pamela Myers of Accokeek in November. The Myers told sheriffs that they had the wrong address as their dog began barking from the yard. The couple asked if they could retrieve their dog, but deputies refused. Minutes later, two shots were fired and the dog was killed, according to a notice of a tort claims filed by attorney Michael J. Winkelman. The Myers were never charged and nothing was seized from their house.
"This has happened before, and without oversight, it will happen again," Calvo said.

Keith Taylor turned his check-writing hobby into an online charity targeting the working poor and watched his donor rolls snowball.
Keith Taylor used to be a $350-a-month philanthropist. As an English teacher at Middle Tennessee State University, Taylor put up a little Web site offering to help people out with small portions of his $33,000 salary. He'd wade through his e-mail inbox and send small checks to people with one-time needs. There was the woman who asked him to help pay for her son's glasses and the man who needed $65 to cover his monthly auto insurance. It was direct and personal, charity scaled down to the basics.
Television interviews and profiles of the check-writing professor followed. "I was the crazy guy giving his money away," he says. "I just wanted to tell people, if you need help let me know. That's all it was supposed to be."
Taylor, 41, didn't count on becoming the Muhammad Yunus for America's working poor. Yunus, the 2006 Nobel Peace Prize winner, launched the microcredit movement out of his Grameen Bank in Bangladesh. A $100 loan can make a big difference to a farmer in Bangladesh who needs an ox.
Taylor opened up his hobby in 2002 to anyone wanting to help strangers with short-term money problems--as fast-growing a demographic as any in this current economic swoon. The average Modest Needs grant of late is $560 and goes to those who need help with a month's rent or a doctor bill or money to fix a car to get to a new job. The check goes not to the recipient but to the bank, business or landlord that needs to be paid.
Modest Needs funded 1,582 people last year and gave away $884,990, up from $250,000 in 2005. So far this year it has given away $688,434, on pace to top last year's mark. Taylor moved his operation in 2003 from behind his desk in Nashville to New York, where a staff of five in a brownstone basement in Manhattan read through the online submissions. They get 2,000 applications per month. Only 20% win final approval. Once approved, requests appear on the site for 45 days. Half of those grant-seekers don't get funded in time, but they can reapply once more.
The Modest Needs Web site still retains the personal, bare-bones feel of Taylor's original inbox. Visitors to the site scroll through requests to buy new tires for a single mother in Fresno, Calif. or pay a cancer patient's hospital bills in Warsaw, Ind. Donors create an account and contribute a little bit every month to rack up "points," which can be applied toward meeting a recipient's total request. The Herb Alpert Foundation has promised to match any donations, contributing $1.4 million so far. To avoid tapping individual donor accounts for its own overhead, Modest Needs has raised operating funds from the Harnisch Foundation and the Omidyar Network.
Modest Needs is one of a new crop of Web not-for-profits that put a face on charity and give donors the sense that they're fixing problems directly. Kiva is a popular site connecting lenders to entrepreneurs in developing countries. On GlobalGiving you can donate to clean water projects for villages in Morocco's Atlas mountains or support girls' soccer teams in Rwanda. DonorsChoose advertises a roster of classroom proposals submitted by U.S. teachers. Contributing to a specific project gives donors a sense of control, says Arthur Brooks, a professor at Syracuse University who studies philanthropy, activating what he calls "the happy part" of the brain's cerebral cortex.
