Notice this was a FULL COMMITTEE hearing. That means ALL committee members are welcome and encouraged to attend. It means that ALL committee members on both sides of the aisle were well-aware of this hearing being called by Senator Dorgan. Keep in mind that this was an "oversight" hearing.
Who showed up? Senator Dorgan, the Chairman, and eventually... Senator Pryor. Both gentlemen are Democrats. Hmm... Are there no Republicans on this committee? It was afterall, a "full committee" hearing... Did partisan politics keep these duly-sworn Members of the U.S. Senate from doing their duty and attending the People's business?? Enquiring veterans want to KNOW! The Republican leadership couldn't spare ONE Senator to attend this hearing? Not one? Just curious. I saw what I saw.
One member of the audience had special reason for being there. Both of her parents and a nephew are DEAD because of this program that the Bush Administration is bull-dozing forward through the mechanism of Secretary of Transportation Mary Peters and a gaggle of slick-tongued lawyers Hell-bent on subverting the letter and intent of the law, and snubbing their noses at a Congress that told them via over-whelming bi-partisan legislation to NOT proceed with this program.
Madam Secretary Peters assured me before the hearing that she most definitely takes border security and our sovereignty into consideration in her administration of the Department of Transportation. After hearing the testimony, it is this veteran's opinion that she is in contempt of both Congress, and the American people, and should be relieved of her duties, along with her counsel, who gave snake oil salesman a whole new meaning today.

Listen to the hearing yourselves. Listen to Inspector General Scovel, and then listen to Secretary Peters and you will hear why a growing number of people are suggesting she should be in prison. When you need legal counsel to testify before Congress... it sures seems questionable what agenda you are trying to either hide or protect.
I'm no fan of the leadership in either major party, so do not assume this is a GOP-bashing. It is simply madness what is going on in our nation's capital. So many people that have sworn an oath to God & Country are betraying you and I on a daily basis. Get off your butts. Get involved. Freedom is NOT free.
The Body Count keeps going up. The blood on the hands of those sworn to protect America is disgusting. Traitors smile and nod at you while they sell your children's and grandchildren's future for yet another 30 pieces of silver.

The Bush Administration has done nothing about the national debt... oh, other than to run it up more than the previous 42 Presidents COMBINED!
The Bush Administration has allowed more Americans to be killed on American soil by illegal alien insurgents since 9/11/2001 than died fighting the Vietnam War.
The Bush Administration has not supported, funded, or enforced our immigration laws at all, and believes the more, the merrier.
The Bush and Clinton Administrations both abandoned the American citizen in favor of the illegal foreign national, in direct violation of Federal Law and the Constitution.
Last year alone, 16,000,000 people came to the U.S. under the VISA Waiver Program. We have no clue who these people are until they hit the ground on U.S. soil. The hearing linked below is the Senate Judiciary Committee hearing that took place this past Thursday.

Walter Jones became the first member of Congress to sign a pledge to fund construction of a barrier between the U.S. and Mexico. In signing the pledge this week, Jones, who represents the state's 3rd Congressional District, vows "to vote for, fully fund, and speedily expedite the construction of a secure double fence across the entire U.S.-Mexico border within six months after the convening of the next Congress." Founded in 2007, Fence By Date Certain is a non-partisan, non-profit group dedicated to persuade the federal government to build a secure fence the length of the U.S.-Mexico border. Jones said Thursday he supports securing the nation's borders as a "key part of the war on terror." "We're at war with terrorism and we've got to secure our own borders. Building the fence is not the only thing that has to be done to increase our security, but it's a good start," Jones told the Daily News. "We, as a Congress, have passed legislation that said this nation should build a fence and it hasn't been built yet. I expect this pledge to be signed by a number of members of Congress ... of both parties." Jones said the goal of having the fence fully funded within six months is a realistic benchmark because "the American people and the people of the 3rd District have already spoken and they want this security." While Jones is addressing the illegal immigration issue on Capitol Hill, Beaufort County Commissioners have taken steps to target illegal immigrants at the local level. At a special meeting scheduled for Jan. 17, commissioners will meet with Michael Hethmon, general counsel for the Immigration Reform Law Institute. They are to discuss what authority they have to prevent illegals from becoming a drag on the local economy. The board has already weighed denying health department services to clients that cannot prove U.S. citizenship. "I support his position 100 percent," Commissioner Hood Richardson said Thursday off Jones' pledge. "It's high time someone did something about this." Jones is scheduled to speak to Beaufort County Republicans at a meeting at Hog Heaven restaurant Thursday. Richardson said he and fellow republicans expect Jones to support their local efforts to combat illegal immigration. "It's certainly an issue we will push him on and it sounds like we'll have his support since he's signed on to this," Richardson said. "I think we are all in agreement that we need to secure the borders of the United States." Jones said city, town and state governments across the nation are beginning to take on the issue of illegal immigration because "they have lost confidence in Congress to do anything." "I definitely will support local officials that feel they need to do something about this issue at the local level," Jones said. "It's a huge issue. How can we be over in Iraq securing the Iraqi borders when we can't secure our own?" Last year U.S. Customs and Border Protection exceeded a goal of having at least 145 miles of federally policed fencing along the U.S.-Mexico border, according to the U.S. Department of Homeland Security's Web site. That will add to the nearly 300 miles of pedestrian and vehicular fencing already in place and is the first step to building 670 more miles of fence, according to the Web site. James P. Pinkerton, acting chairman of Fence By Date Certain, received Jones' pledge and lauded his decision to join the effort to build the border fence. "Walter Jones is a courageous man," he said. "As a longstanding opponent of any form of amnesty, and of any and all attempts to diminish America's hard-won sovereignty, the Congressman continues to demonstrate that there is nothing 'virtual' about his rock-solid commitment to safeguarding America."

Former First Lady Nancy Reagan coined two phrases during the 1980's that seem appropriate today. 1. "READING IS FUNDAMENTAL." (You have to read these bills yourself!) 2. "JUST SAY NO!" (Just say NO to blindly supporting legislation!)
There are currently two pieces of legislation working their way through the House and Senate, with a flurry of unqualified support and special-interest endorsements, despite warnings that these bills threaten the 14th Amendment (H.R. 4088 & S. 2368). This is just another nibbling away of the Constitution.
Members of Congress and the American people have been told that H.R. 2399's inclusion in the SAVE Act is nothing to worry about, that most of it is already law, and that the portion of most concern to some, Section 141, "is already law." That is simply not true. The law referred to is Title 8, Chapter 12, Subchapter II, Part VIII, 1324a: (emphasis added)

"(C) It is not a violation of clauses (ii) or (iii) of subparagraph (A), or of clause (iv) of subparagraph (A) EXCEPT where a person encourages or induces an alien to come to or enter the United States…"

"(C) It is a DEFENSE to a violation of, or an attempt or conspiracy to violate, clause (iii) or (iv) of subsection (a)(1)(A)…" (Remaining language in this section of the SAVE Act and Title 8 are identical.)
The SAVE ACT is the 2007 "feel good" legislation leading into the 2008 Presidential campaign season, just as the "Secure Fence Act of 2006" was the "feel good" legislation leading into the 2006 election.
Read U.S. Code, Title 8, Chapter 12, Subchapter II, Part VIII, § 1324
In layman's terms, according to Section (A)(v)(I & II), and Section (B), clauses (iii & iv): Any person who engages in any form of aiding and abetting of illegal aliens, or engages in any conspiracy to aid and abet shall be punished, and if that aiding and abetting or conspiracy to aid and abet "places in jeopardy the life of," or "results in the death of any person" that person "shall be punished by imprisonment up to 20 years" or life in prison, or could even receive the DEATH PENALTY.
Every American is "in jeopardy" of suffering serious bodily injury or death because of the conspiracy of the religious organizations who want immunity from "aiding and abetting" the invasion.
Count the bodies on the "Wall" at the Vietnam War Memorial in Washington, D.C. As you walk past all the names of the Everyday American Heroes who made the ultimate sacrifice, remember:

Remember the Secure "our talking points before the election" Fence Act of 2006. What? No fence? Just talk? They passed H.R. 6061. The President signed it. They now play charades and clever games to remove the funding so it will NEVER be built! All we got was something to "feel good" about, and the politicians got to stand up and say "I voted for it. I voted to fund it." Do not let that same dog and pony show woo you into supporting the SAVE Act. Keep the invasion of our country on the third rail of politics. Every Member of the House is up for re-election. All of them! They all want this subject to go away, without doing anything real. U.S. Code, Title 8 is all the legislation we need to stop the aiding and abetting. Don't let them water down Title 8 by giving religious organizations immunity, an amnesty that is never-ending. Stop drinking the koolaid!
SAVE American lives, not some "ACT" that will just help continue the status quo. Deploy troops to secure the border. This F.I.R.E. INSPECTION gives the President and Congress a failing grade. The bi-partisan SAVE Act would only give the politicians another "talking point" for their campaigns, and would give religious organizations immunity for conspiring to aid and abet. Read these bills, and stop taking anyone's endorsement for gospel. Tell these pandering traitors: Protect my country and stop acting like new legislation and a growing bureaucracy is the answer, or YOU'RE FIRED!! Call your state legislators and tell them to call their Congressman and...
JUST SAY NO TO THE SAVE ACT!

Below are brief comments on various sections of the SAVE Act:
Section 101: MANPOWER The government's "black ops" partner BlackWater is being encouraged to recruit our best and brightest Border Patrol Agents for border security work in Iraq? How are we supposed to backfill that experience when what we really need is to increase our Border Patrol?
Section 102: TECHNOLOGY It has already been approved to place military on the border, so why do we need to develop a plan? Can we not use the plan already prepared for border security in Iraq? Why not bring home our Border Patrol Agents from Iraq? Is Iraq's border security more important than our own? Who's kidding who here? The sovereign nation of India has thousands of miles of borders, but they know how to stop the barriers from being compromised: 160,000 troops. Cameras are nice to watch people stream across, but the objective is to STOP them from doing so in the first place, not collect video and snapshots for your photo album.
Section 103: INFRASTRUCTURE Ask Speaker Pelosi or Senate Majority Leader Reid if they'll snatch the funding that isn't even in this bill out from under it like they are doing the Secure Fence Act funding? Show me the money! Where will the money come for this? The same place the Secure Fence Act money came from, and then was removed from? Don't believe it for a minute. Don't "feel good" about future promises. Enforce the laws NOW. Article IV, Section 4 does not say "we'll try…" it says GUARANTEE PROTECTION AGAINST INVASION. That means deploy the troops NOW!
Section 104: AERIAL VEHICLES AND SURVEILLANCE SYSTEMS We know we are being invaded. Enough of the pilot programs rhetoric. Put the military on the borders as approved over a year ago. The only winners in these high-tech monitoring programs are the fat-cat special interest groups funding the campaigns of the Senators and Congressmen pushing them. There is a lot of "consider, consult, and assess and consult" rhetoric in this virtual monitoring jumble of words. Deploy the military as already authorized. Stop talking in circles while doing nothing. Phrases in this section like "subject to the availability of appropriations" means it will NEVER HAPPEN! Remember the 700 miles of fence?
Section 111: NATIONAL STRATEGY TO SECURE THE BORDERS This section is long on words and short on meaning. It says a lot, but does nothing. Re-deploy our troops from Germany or South Korea back home where they can protect the number one border on the list of priorities to protect: the U.S. border. We won't need to "assess and assess some more" about new detention centers if we STOP the flow of illegal aliens into the country, duh. Stop the social welfare gravy-train that is enticing illegal aliens to come here, and clamp down on employers who hire them, and most will self-deport. All you need is already in U.S. Code, Title 8. Enforce the law. Stop playing Americans for fools and suckers.
Section 141: ALIEN SMUGGLING AND TERRORISM PREVENTION This section is simply a complete copy of H.R. 2399. The comments made on the floor of the House in May, 2007 tell a story. Apparently, this was added to shut up the religious groups who fought H.R. 4437 with the statement: "If someone provides water to a person who is dying of thirst and this person came across the border illegally, the person providing such assistance could be prosecuted for a felony." That is a bogus excuse. The Volunteer Protection Act would more than cover such a situation.
In May of 2007, on the Floor of the House, these statements were made about H.R. 2399, (which is now included verbatum in the SAVE Act) Mr. KELLER of Florida stated: Snip:
"There is a discussion and debate now about what the language should be. No one wants to prosecute those who are engaged in Good Samaritan activities. Snip: I have the bill before us that we are debating. This is the last version, the one we're debating on. And the date on it is May 22, at 1:35 p.m. It is now 3:40 p.m. It's as thick as a small town phone book, and yet we've only had it for a couple of hours. There have been no hearings. No subcommittee markup. No full committee markup. Now, I'm not someone who usually gets up and complains about process, but this is an example where someone like me and others of the committee could have been quite helpful if we had had hearings, could have had a markup. There are a couple of major flaws in this bill that I'll talk about. And I say this in good spirit. I'm going to actually vote for this bill because I think your intentions are correct. But let me just give you two examples. First, if you help smuggle in a terrorist, you can go to jail for up to 30 years. Under the language of this bill, you have to show that the smuggler knew that the person was a terrorist and knew that he intended to engage in terrorist activities.
Now, you don't have to be Johnny Cochran to successfully defend a defendant in that particular case. The standard is just almost impossible for a prosecutor to prove. For example, let's say that you have Mohammad Atta on the stand, and he’s just been detained by a Border Patrol agent and we want to apply this new provision. If I was the defense attorney, my first question to the Border Patrol agent would be, Mr. Border Patrol Agent, you've arrested my client. You want to send him to prison for 30 years. Did Mr. Atta show you his al Qaeda ID card? No? Did Mr. Atta show you the picture that he has with Bin Laden and his family? No? Did he show you some videotape showing him on the monkey bars in the Afghanistan training camps? No? Well, if not, how do you know with mathematical certainty that this guy is a terrorist? It's almost impossible to prove. That's an example of something we could have fixed during the markup, saying, if you brought this person into the country for financial gain and he's a member of the terrorist watch list, we're going to give you an enhanced sentence up to 30 years. But we didn't have that chance because there was no markup. Another thing that's flawed is, it doesn't fix the Good Samaritan exception. There's language in this bill that talks about Good Samaritans. Specifically, it says it is a defense, if you are arrested for a religious organization or one of its members to provide room, board, travel, medical assistance or other basic living expenses. That's the situation of a nun, for example, helping someone who's going to die out there in the 110-degree heat. We all believe that that should be provided. But I read you the transcript of the Attorney General; he said, because this Good Samaritan exception needs to be tightened, and it does. For example, under this law, because you didn't talk with us about fixing it, if you are a member of the Red Cross or you're a member of the United Way, which is not religious affiliated, you could still be prosecuted. Now, none of us wants that to happen. My point is, as this bill moves forward, I'm willing to support it because I support the intent behind it. I support getting tough with alien smugglers. But the bottom line is, we need to fix this in conference. We need to work with Republicans and Democrats to include our input to make sure that at the end the day we have a much better bill that we can be proud of."
Mr. Hill, the bill sponsor stated: Snip: "It is estimated that there are currently more than 20 million illegal immigrants in this country. The cost of illegal immigration to our health care system, public education system, prison system and social services continues to rise without any sign of stopping or slowing."
Honest men and women show realize all the new "feel good" legislation in the world won't solve a problem if the men and women we elect refuse to enforce the laws already on the books. Selective enforcement of laws of convenience is what got us into this mess.
Section 152: FINDINGS Congressman Hill stated on the floor of the House we have 20,000,000 illegal aliens. Even that number is low by as much as one half, and yet still doesn't qualify as "invasion-level" numbers? Congress passed, and President Clinton signed into law the ICE 287(g) Delegation of Immigration Authority Program eleven, count them 11 YEARS AGO, during the 1996 "Feel Good" dog and pony legislation show. Subsequent Congresses and Presidents have failed to fund or promote the 287(g) Program. Campaign promises and election year promises are usually what you think they are: FLAT OUT LIES. Look at what they have done in the past on these issues. Do not believe what any of the candidates tell you about what they will do. How many billboards have you seen promoting WIC programs for illegal aliens? How many billboards have you seen promoting 287(g)? Starting to get the picture?
Section 201: MANDATORY EMPLOYMENT AUTHORIZATION VERIFICATION Never since the dawn of civilization has any government been successful at centralized control of jobs. Mandatory use of e-verify places the federal government between every employee and a possible employer. We have in place laws which make it illegal to hire illegal aliens. Enforce those laws. The reason we are in the current mess is LACK OF LAW ENFORCEMENT – NOT A SHORTAGE OF LAWS. We have an overage of attorneys and a shortage of ICE Inspectors and a shortage of Border Patrol agents. Here, yet again is an attempt for centralized control of the jobs. This proposal does not state that but that is in fact what it does. There is nothing wrong with making e-verify permanent but it must be left voluntary. With this in effect, if I start a business and I want my son working for me, I will need government permission. This, dear reader is extreme socialism / communism, and should scare the Hell out of you that your Congress is promoting this with a smile on their faces. Feel good yet? Have we forgotten "states' rights," or the rights of the individual citizen as defined and protected in the Constitution of the United States? State legislators are also U.S. Citizens, and each of them has a Congressman and two Senators. They should be calling and faxing their respective Representatives in Congress and telling them:
"Reading is fundamental," and JUST SAY NO to the SAVE Act!"
There are a few good ideas in the SAVE Act worth pursuing, and the FIRE Coalition and its partners will be presenting them to Congress, state legislators, and to "We the People" for consideration in the coming weeks. In the meantime, we would suggest you READ H.R. 4088 and S. 2368 yourself before you encourage your Congressman or Senator to support un-Constitutional legislation. Stop drinking the koolaid. Be a responsible citizen. Read the Constitution while you still have one.

State Legislators for Legal Immigration Coalition founder, Pennsylvania State Representative Daryl Metcalfe stated Friday Dec. 07, 2007 during a press conference at the National Press Club in Washington, D.C. the following: "I don't believe there's any legislator that's involved with our coalition that would allow or be supportive of allowing the law to allow any American to aid and abet a criminal or an illegal alien invader, which is what they are. They've come here uninvited. They've come here unauthorized, and we should not allow any individual residing in this country to aid and abet someone who's committing an act of invading our country."
The State Legislators for Legal Immigration Coalition consists exclusively of members of state legislatures across the country, and currently has members from 32 state legislatures. "To Save or Not to "Save Act"  FIRE COALITION STATEMENT ON H.R. 4088, THE SAVE ACT. DECEMBER 3, 2007
The FIRE Coalition has been VERY reserved in respect to making a determination about the merits of H.R. 4088, the SAVE Act. We have, and will continue to act in good faith, and show restraint in that regard. These are our first public comments about the SAVE Act ANYWHERE. They will not be our last. The FIRE Coalition is researching and developing alternative solutions to the areas of the SAVE Act that concern us. I am postponing my trip to Arizona and will be traveling to Washington, D.C. this week instead to address the FIRE Coalition's concerns directly with Members of Congress. We will reserve making a final "informed" decision as to whether or not we will support or oppose the SAVE Act. Most of last week was spent in intense discussion with our partners, membership, and others with an interest in the SAVE Act. The FIRE Coalition puts protecting the Constitution first and foremost in all of our deliberative processes and strategies concerning any legislation. The SAVE Act is no different and will have to pass a Constitutional muster before cementing our support. We have witnessed many others across the country raise issues and concerns based on thorough readings of the actual text of the legislation, and share some of those concerns. Despite the apparent attributes, H.R. 4088 contains many areas of deep concern. There have been numerous public discussions about this, some of them reporting inaccuracies about the SAVE Act. This too is a deep concern of the FIRE Coalition as we would not like to see good legislation damaged or destroyed, nor bad legislation passed based on inaccuracies or incomplete analysis. As a matter of general principle, most legislation would be improved if "we the people" were more involved in the discussions with our respective Senators and Congressmen as an integral part of the "legislative process." A rush to support or oppose legislation without giving due diligence to the particulars is why we end up with so much bad legislation. Principles are only principles if we stand up for them even when it is not convenient. Otherwise, they were merely preferences founded on a series of compromises.
